Article 1. Purpose
These Terms govern the rights and duties of Rodac Technologies LTD (the "Company") and Members, as personal location information subjects, in connection with location-based services in the KixScan mobile app and web app.
Article 2. Application and Consent
These Terms apply when a Member aged 15 or older separately consents before a location feature is used. Members may refuse location consent or device permission and continue using non-location features. Features that require the Member’s location, such as map Data Missions and Data Tasks, nearby location-based events, location validation and Beacons, will not be available without the required consent and permission. Device permission does not replace separate consent required by law.
Turning off device location permission stops future permission-based collection. To withdraw legal consent, request temporary suspension or exercise rights over information already held, use an available in-app rights control or contact info@rodac.co.kr. Turning off a permission alone does not submit those requests.
Article 3. Location Services and Purposes
- Show the Member's current position and nearby sneaker content, Data Missions and Data Tasks, or places on a map
- Verify whether a Capture, Data Mission, or Data Task satisfies a required place, distance, or time condition
- Place and operate Beacons, including radius, duration, and additional Sparx
- Combine a Capture location with product data to create generalized area, store, or market information
- Detect GPS spoofing, duplicate submissions, and other misuse and protect the Service
Beacons affect only Sparx and other non-monetary items. They do not affect KDP compensation, Contributor Rankings, an Elite Contributor Bonus, or Coupon value.
Article 4. Data and Collection Method
Location features use device GPS, Wi-Fi, mobile-network or operating-system location and relevant account/event references. Devices request OpenFreeMap map resources directly; IP addresses and resource requests may reveal the displayed area even without GPS permission. Map-provider processing is described in the Privacy Policy.
The Company does not use background location tracking. Current location is processed primarily on the user's device while the user has the app or map screen open and is using a location function. When the user interacts with backend systems for a Data Mission, Data Task, Capture, or Beacon, the location of that event may be transmitted to the Company. Before introducing background tracking, the Company must amend these Terms and the Privacy Policy and obtain separate consent and device permission.
KixChat does not attach device-derived location to provider requests. Location independently typed into chat is handled under the Privacy Policy.
Article 5. Fees
The Company charges no separate fee for the location-based service. Mobile data charges, device costs, and third-party service charges follow the Member's carrier or relevant provider terms.
Article 6. Use and Retention
Current map position is primarily processed on the device during active use. The Company does not continuously store it or track in the background. Event transmissions follow Article 4.
Precise location tied to Captures, Data Missions, Data Tasks or Beacons is retained only until the relevant validation, fraud-prevention or review purpose is achieved, then destroyed immediately unless a lawful exception applies. Generalized data may remain only where genuinely anonymous under the Privacy Policy.
Location collection/use/provision confirmation records are automatically recorded under Location Information Act Article 16(2) and kept for 6 months, subject to statutory withdrawal/deletion rules. They record processing facts without preserving precise coordinates. Other personal location information is retained only on a lawful basis and for its applicable period.
Article 7. Third-Party Provision and Notice
The Company does not ordinarily disclose account-linked precise event location to an independent third party. Direct-device OpenFreeMap and applicable CDN processing is described in Article 4 and the Privacy Policy. Location-based statistics, analytics and external data products use genuinely anonymous information unless another lawful basis and the required safeguards permit personal-information processing.
If the Company introduces a feature providing personal location information to a third party designated by the Member, it will identify the recipient and purpose in advance and obtain separate consent. As required by law, it will immediately notify the Member's device or a method preselected by the Member of the recipient, time, and purpose of each provision.
Article 8. Member Rights
- Withdraw all or part of consent to use or third-party provision of personal location information
- Request temporary suspension of collection, use, or provision
- Request access to or notice of the Member's location collection/use/provision confirmation logs and correction of errors
- Request access to or notice of the reason and details where personal location information was provided under law to a third party
Upon withdrawal, the Company promptly destroys personal location information and confirmation logs within the scope withdrawn, unless another law requires separated retention.
Members may also request account deletion through Settings > “Delete my account” and confirmation. The Company processes the request and destroys personal location information in accordance with these Terms and applicable law. A request is not an assertion of immediate deletion. Location-related rights may also be exercised at info@rodac.co.kr.
Article 9. Users Under 15 and Protected Persons
The Company does not admit users under 15. It does not operate the guardian-consent procedure for children under 14 under Article 25 of the Location Information Act. If an under-15 account or related personal location information is discovered, the account is promptly closed and the information deleted, subject only to separately required legal retention.
KixScan does not provide protective tracking for persons covered by Article 26 of the Location Information Act. Members aged 15 or older may use location functions with the required separate consent; any legal representative’s consent required for a minor’s Service agreement remains governed by the Terms of Service.
Article 10. Changes, Restrictions, and Suspension
For material location-feature changes, the Company gives reasonable advance notice and individual notice where required. A planned suspension or closure of all or part of the location-based business follows Article 11 of the Location Information Act: users are notified and the regulatory filing is made at least 30 days beforehand, with the required destruction of relevant information. Emergency technical restrictions are distinct from business suspension or closure.
Location features may be temporarily restricted without advance notice for device or network failure, GPS limitations, emergency maintenance, security incidents, third-party map outages, legal or regulatory requirements, force majeure, or similar unavoidable circumstances. Later notice will be provided where practicable.
Article 11. Safeguards and Liability
The Company applies safeguards proportionate to processing scale and risk, including access restrictions, handling logs, encryption in transit, and incident response.
The Company is liable under applicable law for damage caused by its violation of Korean location-information law. It is not liable, absent its fault, for damage caused by the Member's device or network, technical limitations of location signals, a Member or third party, or force majeure.
Article 12. Disputes
If discussion does not resolve a location-information dispute, a party may seek adjudication by the Korea Media and Communications Commission or mediation by the Personal Information Dispute Mediation Committee. Litigation will be brought in a court having jurisdiction under the Korean Civil Procedure Act and other applicable law.
Article 13. Amendments, Language, Contact, and Effective Date
Amendments are announced with their effective date and reasons. Material or adverse changes receive reasonable advance notice appropriate to their effect. The Company obtains express consent and gives statutory notice where required; Article 10 governs planned business suspension or closure.
